1. Agreement to Terms These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Bill Leary Air Conditioning & Heating ("we", "us", or "our"), concerning your access to and use of the www.billleary.net and www.billlearyhvac.com websites (collectively, the "Sites"). By accessing the Sites, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these terms, you are expressly prohibited from using the Sites and must discontinue use immediately.

Any reliance you place on such information or any DIY (do-it-yourself) troubleshooting attempts you make based on website content is strictly at your own risk. Bill Leary Air Conditioning & Heating shall not be held liable for any personal injury, property damage, or equipment failure resulting from your attempt to repair or modify your HVAC systems without professional assistance.

Limitation of Liability In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Sites, even if we have been advised of the possibility of such damages.


6. Governing Law and Dispute Resolution These Terms shall be governed by and defined following the laws of the State of New Jersey, without regard to its conflict of law principles. Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted in the state and federal courts located in New Jersey, and the parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such state and federal courts.


7. Modifications and Interruptions We reserve the right to change, modify, or remove the contents of the Sites at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Sites without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Sites.
